Specific Terms for Radio & Streaming Services

10.1. Legal Entity and Nature of Service

The Radio & Streaming services provided through the pro.radio platform are operated by Qantum Themes S.L. (hereinafter, “the Company”). ProRadio is a registered trademark of Qantum Themes S.L. – CIF ESB02979078.

In accordance with Article 16 of Law 34/2002 (LSSI-CE) and the EU Digital Services Act (DSA), the Company acts strictly as an intermediary service provider (hosting). The Company provides technical infrastructure (MediaCP, Icecast, AutoDJ) for data transmission but does not curate, select, or modify the content of the broadcasts.

10.2. Mandatory Licensing & Legal Disclaimer

Qantum Themes S.L. does NOT provide music broadcast licenses. The service fee covers technical infrastructure only. The Client is the sole “Communication Service Provider” and is exclusively responsible for obtaining all necessary permissions from copyright holders and collective management organizations.

10.3. Global Licensing Resource List (Non-Exhaustive)

The Client must secure licenses in their originating jurisdiction and/or where their listeners are located. Resources include:

10.4. Notice, Action, and Transparency (DSA Compliance)

  • Reporting: Reports of illegal content/infringement must be sent to abuse@pro.radio.

  • Statement of Reasons: If the Company restricts or suspends a service due to a report or automated detection, the Company will provide the affected Client with a “Statement of Reasons” explaining the decision, as required by the DSA.

  • Appeals: Clients have the right to appeal moderation decisions by contacting our support team with evidence of compliance.

10.5. Fair Use & Network Integrity

  • Connection Limits: Streams exceeding contracted listener slots will be capped.

  • Resource Abuse: High CPU usage from AutoDJ/Transcoding that impacts server health may result in a request for optimization or a mandatory upgrade to dedicated resources.

  • Prohibited Traffic: Using streaming ports for non-audio data (DDoS tunneling, VPNs, etc.) results in immediate termination.

10.7. Free Trial Policy

The Company may, at its sole discretion, offer limited-time free trials (“Free Trials”) to new Clients.

Binding Terms: All terms set forth in this Agreement, including but not limited to Section 10.2 (Mandatory Licensing) and Section 10.3 (Global Licensing Resource List), apply in full to Free Trial accounts. A Free Trial does not exempt the Client from the legal obligation to possess valid broadcasting licenses.

Data Deletion: Upon the expiration of a Free Trial, if the Client does not upgrade to a paid plan, the Company reserves the right to delete the radio station configuration, AutoDJ media files, and listener statistics without further notice.

Abuse & Prevention: Free Trials are limited to one per person/entity. Any attempt to bypass this via multiple email addresses or identities to maintain a permanent free stream is a violation of these terms and will result in an immediate IP-level block.

Right to Terminate: The Company reserves the right to terminate or modify the Free Trial program at any time without notice.

11. Governing Law and Jurisdiction

11.1. Applicable Law

These Terms shall be governed by and construed in accordance with the laws of Spain.

11.2. Jurisdiction

The parties agree to submit to the exclusive jurisdiction of the Courts and Tribunals of Zaragoza, Spain, for the resolution of any legal disputes.
